The Client:
1. The term “I”, “We”, "Us" and/or “Our” refers to the “Client” anywhere in this document.
2. We confirm that the booking details provided by us are correct.
3. We authorise the Studio to do the photographic coverage of our Christmas Mini Sessions 2020.
4. We have received the Studio's price $79 for a 20 minute home studio photo session of our Christmas Mini Sessions 2020. The session will be confirmed for on the full payment at the time of booking made at least 3 hours prior to the session time.
5. If the Studio cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Studio photographer’s illness, then the Studio shall return the deposit to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction or otherwise lost or damaged without fault on the part of the Studio. In the event the Studio fails to perform for any other reason, the Studio shall not be liable for any amount in excess of the retail value of the Client's booking fees.
6. The Studio confirms that the session price also includes 4 high resolution digital photographs of client's choice in JPEG/JPG file format only. Additional digital photographs from the same photo session can be purchased by the Client at the rate of $20 per image. The Client shall make a selection of 4 photographs through their individual password protected gallery on this website. The photographs will then be delivered through online file transfer platform Google Drive. Any additional photographs purchased by the Client will also be delivered through the Google Drive within 10 days after the photo selection.
7. We agree the Copyright in all photographs is owned by the Studio. The Studio shall own the copyright in all raw/digital images and photographic materials created and shall have the exclusive right to make reproductions. The Studio shall only make reproductions for the Client or for the Studio’s portfolio, samples, self-promotions, entry in photographic contests or art exhibitions, advertising, illustration, editorial use, or for display within or on the outside of the Studio’s premise, including printed materials, media on the World Wide Web, and any current or future digital media. If the Studio desires to make other uses, the Studio may so without oral or written permission of the Client.
8. We give permission to the Studio to use any image of our photo session for industry competitions and as required subsequent usage and for reasonable general promotional advertising for the Studio.
9. We understand that these photographs are only to be used for personal use and may not be copied or reproduced unless written approval has been granted by the Studio. The raw/digital negative files remain the property of the Studio.
10. Should a nominated photographer not be available for any reason, the Studio will notify the Client of the change as soon as it is known and will assist in booking for another photo session or a refund, whichever is the Client’s choice.
11. The details supplied and times booked through our online booking system form part of this agreement and we agree to make every effort to cooperate in order for the Studio to fulfil its contracted photographic duty. We acknowledge the Studio cannot accept responsibility for the ‘extent’ of the photographic coverage if these details are incorrect or if we chose not to follow the agreed to schedule.
12. To avoid disruption to the photographic coverage and to allow the Studio to fulfil its contracted duty, other photography by family will not be permitted in the Studio.
13. The Studio will not consent or engage in the taking of any photographs which the Studio considers inappropriate or offensive in any way. We acknowledge that the Studio has the right to refuse to take any photograph which is inappropriate or offensive, and that the Studio reserves the right to end the photo session at any time in circumstances where the Studio is asked to take such photographs.
14. We acknowledge that the Client and any of the family members are to at all times respect the Studio and treat the photographer with respect. Any disputes, disagreements etc. are to be discussed with the Studio’s photographer in a
professional and respectful manner. We acknowledge that the Studio photographer reserves the right to end the photo session at any time in the event he/she feels threatened, intimidated, treated disrespectfully, attacked and/or is placed in an unsafe situation which could potentially expose the photographer to any danger. In the event the Studio exercises that right, the Client is not entitled to any refund whatsoever and shall ask the Client to leave immediately.

15. We accept the responsibility to contact the Studio at least 2 hours prior to the photo session in an event where we are not able to make it to the photo session or want to cancel it for any other reason. In that case the full session fee will be refunded to the Client's. If the Client is unable to make it to their booked session and confirms the same in less than 2 hours prior to their photo session then the session fee will not be refunded. Instead, the Client will be able to book another available slot. If another slot is not available through our online booking system then we shall contact the Studio to check if it can be manually booked outside of available booking slots.
16. The Studio shall carry out this assignment with due and professional diligence. Elements beyond the Studio’s control include faulty material, equipment failure, damaged and exposed film, loss of film/photos/negatives/digital files in transit between the Studio and professional laboratories employed by the Studio, loss or damage to film, negatives/digital files and proofs during processing and developing either by the Studio or professional laboratories employed by the Studio, industrial disputes, civil disturbances, or weather conditions which may inhibit or prevent the Studio completing in whole or in part this assignment. In this case the Studio shall not be liable for its complete performance of the assignment. It is agreed that the liability of the Studio shall be limited to a refund of any money paid under this agreement which shall be in full & final satisfaction of any damage or loss suffered.
